What is the Clery Act?

The Clery Act, named after Jeanne Clery, is a federal statute that requires colleges and universities to disclose certain crime statistics that occur on or near campus and issue timely warnings and emergency notifications in situations that pose a threat the campus community.

What is Campus Security Authority (CSA)?

A Campus Security Authority (CSA) is an individual who is legally required to notify the Notre Dame Police Department about certain criminal offenses reported to them.

CSAs include: 

  • Members of a campus police or security department;
  • Individuals who have responsibility for campus security but who do not constitute a campus police/security department (e.g. an individual responsible for monitoring the entrance to a facility);
  • Any individual specified in an institution’s statement of campus security policy as an individual to whom students and employees should report criminal offenses;
  • An official of an institution who has significant responsibility for student and campus activities, including but not limited to, student housing, student discipline and campus judicial proceedings. An official is defined as any person who has the authority and duty to take action or respond to a particular issue on behalf of the institution (e.g., deans, directors, student activities office, coaches, club advisors, Office of Community Standards, Rectors, resident assistants, etc.)

Pastoral and professional counselors, while functioning in that capacity, are exempt from reporting obligations under the Clery Act, and are not required to report crimes of which they learn while acting in their capacity as confidential resources.

What gets reported and when?

The Clery Act requires that the following crimes and arrests be reported to the University when they occur at any of the reportable locations listed below.

Crimes

  • Criminal homicide
  • Sexual assault
  • Aggravated assault
  • Domestic / dating violence
  • Stalking
  • Robbery
  • Burglary
  • Motor vehicle theft (includes theft of an electric scooter)
  • Arson
  • Hate crimes
  • Arrests or referrals for weapons possession, drug violations, or liquor law violations

Locations

  • On Campus
  • University owned or controlled property
  • Public property within or adjacent to University property

When in doubt, report it out!

If you are unsure whether or not a particular crime is reportable, please contact NDPD as soon as possible and report it anyway. This will enable the University to take appropriate measures, if needed, to notify and/or protect the members of the Notre Dame community.
